CrowdJustice: Update

Writer's picture: Invisible EnemyInvisible Enemy

Since the release of the BBC documentary Britain’s Nuclear Bomb Scandal: Our Story, that delved into the UK's post-war atomic weapons program and its enduring impact on service personnel and their families.

The Nuclear Veteran Community’s campaign has gained significant momentum. Their work so far alongside the public pressure has forced the Labour Government to announce a review into the missing medical records. Despite this progress, the Ministry of Defence (MoD) is still dragging its feet.

Now, the legal team is preparing formal proceedings. Health assessments are underway to prove that withholding these records is causing ongoing harm. Without access to their own medical history, these veterans are left without answers, without support, and without justice.

They urgently need to raise the final funds to push ahead with legal action. This case is at a turning point.

Both the Prime Minister and the MOD have now received the notice that, unless the demands are met, the legal team has instructions to issue proceedings in 2025 and to pursue formal criminal complaints to the Metropolitan Police to formally investigate the Veterans’ legitimate concerns that officials over decades have engaged in misconduct in public office to suppress the Veterans’ medical records.

The demands specifically requested formal engagement by the government with the legal team regarding the proposed Special Justice Tribunal and that the government make a public announcement to confirm (a) the removal of all continuing and existing restrictions on medical test records relating to the Veterans, and (b) that the government will fast track disclosure of such to them and the Veterans’ legal representatives. The MOD was asked to reply to those demands by 31 December 2024.

The MOD missed the deadline to respond, continuing their pattern of avoidance and delay. With no substantive engagement and a continuing failure to disclose medical records, the Veterans’ representatives wrote again to the MOD in January 2025 to say they are now preparing to escalate the dispute into formal litigation. Under pressure, the MOD has promised to respond in January, though the legal team have not received a response to date.
